\"Customer\": any natural or legal person with whom CAPM-Musée de la Grande Guerre concludes a sales contract.
Hereinafter collectively referred to as the \"Parties\", and individually a \"Party\".
\"Order\": any contract binding the customer to CAPM-Musée de la Grande Guerre for the realization and execution of the sale.
\"Online Ticketing\": specific portal on the site of the Great War Museum allowing the subscription of one or more services.
\"Dated ticket\": ticket valid only on the day for which a reservation was made. Allows you to go directly to ticket control.
\"Undated ticket\": ticket valid for 1 year from the date of purchase, excluding privatization. Allows you to go directly to ticket control.
\"E-Ticket\": electronic ticket. Electronic ticket to print.
Allows you to report directly to reception.
\"M-Ticket\": mobile ticket. Dematerialized ticket to download on a smartphone. Allows you to report directly to reception.
1. General
1.1 - These General Terms and Conditions apply to any Internet order on the site https://museedelagrandeguerre.tickeasy.com/ for one or more services subscribed by the customer from the Internet ticket office of the Great War Museum. Said services for dated tickets can only be used for the day(s) chosen by the customer when placing the order. These General Terms and Conditions can be consulted on the website.
1.2 - The customer declares to have the capacity to conclude this contract, that is to say to have the legal majority and not to be under guardianship or curatorship.
1.3 - Placing the order implies express and unreserved acceptance by the customer of all the clauses and conditions provided for in these General Terms and Conditions. Consequently, the customer declares and acknowledges having perfect knowledge of it and therefore waives the right to rely on any other document.
1.4 – The CAPM-musée de la Grande Guerre reserves the right to adapt or modify unilaterally, and at any time, these General Terms and Conditions. In the event of modifications, the conditions applicable to a purchase are those in force on the day of the order.
2 - Orders
2.1 - Orders for services are subject to these General Terms and Conditions as well as the visitor regulations of the CAPM-Museum of the Great War.
2.2 - To place an order, each customer must be identified after having previously created a secure account using identifiers (login and password).
- Before definitively registering an order, the customer will have the opportunity to check his selection (order) and can modify it at his convenience.
For dated ticket orders, the customer is invited to check the date and time reserved.
- The order will only be definitively recorded upon the second and final validation of the order summary screen. This last \"click\" is equivalent to the handwritten signature referred to in article 1341 of the civil code (hereinafter referred to as \"the acceptance click\"). From the acceptance click indicated above, the order is considered irrevocable and can only be called into question in the limited cases provided for below. Before this last click, the customer can identify his errors and correct them.
2.3 - It is expected, from the registration of the order placed, that the customer will be automatically redirected to a page confirming the final validation of the order. The customer will also receive a confirmation email at the end of which the CAPM-museum of the Great War will acknowledge receipt of the customer's order. By retaining this
email and/or by printing it, the customer has proof of his order which the CAPM-musée de la Grande Guerre advises him to keep.
2.4 - The purchased tickets will be sent to the customer, by e-mail, as an attachment in PDF format. The tickets will also be downloadable by the customer in their account. The customer account is accessible after identification by login and password.
3 – Prices
3.1.- The applicable prices are those in effect on the day of the order. The CAPM-musée de la Grande Guerre reserves the right to modify its prices at any time.
All orders regardless of their origin are payable in euros net of taxes.
– Condition for granting reductions or freebies: The customer acknowledges having read the reductions or freebies to which he or she is entitled for the purchase or order of tickets or products, these reductions being indicated in the pricing conditions displayed.
Visitors benefiting from reduced rates or the child rate must present proof to attest to the benefit of this rate, when they come to the Great War Museum if the purchase was made online (presentation of a document allowing to prove eligibility for the corresponding rate, as well as a valid identity document). If these supporting documents are not presented on site, the customer will not be able to access the museum.
(ticketing and services concerned), unless they pay a supplement representing the difference with the full price.
A customer eligible for a reduced fare, and who has purchased a full-fare ticket, cannot claim a refund of the difference.
- In the event of partial closure of the museum or reduction of opening hours. Tickets and annual passes are extended during the closure.
3.2 – The payment methods accepted for orders subject to these General Terms and Conditions are the bank card (cards from the Carte Bleue, Visa, Eurocard/Mastercard networks are accepted) and holiday vouchers.
The site of the Great War Museum is subject to a security system. Data entry and transmission are secured by the SSL and 3D Secure protocol.
3.3 - The customer has the guarantee that his bank account will only be debited once and only once by the CAPM-musée de la Grande Guerre via its secure payment site by payzen, for the total amount of the order for the services.
4 - Access terms
Visiting the museum is free.
If you wish to participate in a guided tour, workshop visit, conferences or any other event linked to the cultural program, it is essential to reserve your place via the online ticket office (except for “major events”). The museum cannot guarantee available places without prior reservation at events. The visitor must arrive 15 minutes before the start of the guided tour or any other events.
In order to ensure the safety of visitors, the Great War Museum applies the preventive measures decided by the government for public administrations. All people must go through security checks.
The CAPM-Museum of the Great War reserves the right to refuse access to any person whose attitude, behavior or dress could be deemed likely to create disturbances within the establishment or to hinder the visit.
In this case, no refund can be requested by the customer who has been refused access to the museum for the reasons mentioned above.
Parking is authorized in the car parks provided for this purpose. Parking is free and monitored depending on available spaces.
5 - Obligations of the parties
5.1 - The Great War Museum undertakes to execute the order for services, subject to the provisions of article 9 below and compliance by the client with the procedure provided for in article 2 above.
5.2 - In the event that the CAPM-museum of the Great War finds itself, after final validation of the order, unable to honor its obligations, the CAPM-museum of the Great War reserves the right , in order to guarantee as far as possible a product that meets the customer's expectations, to modify the initial allocation of services provided that they correspond to the customer's expectations; where applicable, the Great War Museum must inform the customer of any modification in good time.
5.3 - Each visitor must comply with the visitor regulations displayed at the entrance to the Museum of the Great War.
5.4 - The customer undertakes to respect any instructions communicated by the Great War Museum concerning the organization of services and visits, whether free or guided tour (shooting without flash for private use only).
6 - Responsibilities
6.1 – The CAPM-musée de la Grande Guerre may exempt itself from all or part of its liability by providing proof that the non-performance or poor performance of the contract is attributable either to the client, or to the fact, unforeseeable and insurmountable, a third party unrelated to the provision of the services provided for in the General Conditions of Sale, or in a case of force majeure.
In a case of force majeure, or fortuitous event forcing it to do so, the Great War Museum may cancel the performance of the services or change its programming, without payment of any penalty or compensation.
The following are considered force majeure: wars, riots, insurrections, government or legal restrictions, fires, earthquakes, storms, floods.
6.2 - The customer will be held responsible for any damage, direct or indirect, that he may cause during his presence in the Great War Museum, whether to the staff and/or the customers of the museum, or with regard to any material made available to the customer by the museum.
6.3 - The Great War Museum declines all responsibility in the event of loss or theft or use of copies without the buyer's knowledge, including within the museum.
Any person who illegally reproduces a ticket and/or uses a counterfeit ticket may be subject to criminal prosecution.
7 – Cancellation / modification
In accordance with article L121-20-4 of the Consumer Code, tour or show tickets are not subject to a right of withdrawal.
The ticket is non-exchangeable, non-modifiable or non-refundable, unless the service is canceled by the Great War Museum. It cannot be transferred or sold.
- For gift tickets: tickets cannot be refunded even in the event of loss or theft.
- For dated tickets: tickets are neither returned nor exchanged, except in the event of cancellation of a guided tour or any other event and a decision by the organizer to refund the tickets. In the event of a refund decided by the organizer, this will only be made in favor of the initial purchaser against surrender of the ticket.
8 - Cancellation
The Museum of the Great War reserves, without payment of any penalty or compensation, the right to cancel the performance of the services or to modify its programming if force majeure or fortuitous events force it to do so.
9 - Applicable law, claims, and disputes
9.1 - These General Terms and Conditions are subject to French law.
9.2 - Any complaint, whatever its nature, must be sent in writing to the CAPM-musée de la Grande Guerre no later than the day of the visit. This letter must specify the order number as well as the precise reasons in support of the said complaint to the address: Musée de la Grande Guerre, rue Lazare Ponticelli 77100 Meaux.
9.3 - In the event of difficulties regarding the interpretation or application of these conditions, the parties will try as far as possible to resolve their dispute amicably. Any disputes to which these conditions of sale may give rise must be brought, even in the event of multiple defenders or a warranty claim, before the territorially competent court.
10 - Personal data
10.1 - The information collected on the Internet ticketing is intended for the Great War Museum. They are subject to computer processing for the purpose of processing customer requests and the commercial management of the Great War Museum.
The data provided by the customer is processed by the Great War Museum for the following purposes:
- Response to requests for information made on the site,
- Placing and managing orders, sending digital newsletters when the customer creates their account on the online ticketing service
- Sending digital newsletters when the customer creates their online ticketing account and has given their consent.
- Sending commercial information when the customer has given their consent
- When current legislation authorizes it, the establishment of general statistics on consultation of the site in order to improve the services that the CAPM-musée de la Grande Guerre offers on this site.
10.2 - In accordance with law n°78-17 of January 6, 1978 relating to data processing, files and freedoms, the customer has a right of access, rectification, deletion of information which concerns him, that the customer can exercise this by contacting the Museum of the Great War domiciled at rue Lazare Ponticelli 77100 Meaux- accueil.m2g@meaux.fr under the direction of development responsible for processing.
